Terms of Service

1. Agreement

These Terms of Service (the "Terms") form a binding agreement between you and Bosq Aspen LLC, a Colorado limited liability company with its principal place of business at 312 S Mill Street, Aspen, CO 81611 ("Bosq", "we", "us"). They govern your use of www.bosqaspen.com (the "Site"), your reservation of a table, and your dining experience with us. By using the Site or making a reservation, you agree to these Terms.

2. Reservations & deposits

Reservations at Bosq are made through our third-party partner Tock (Squarespace, Inc.) at exploretock.com/bosqaspen. Tock collects your name, email, phone number, and a credit-card token used to authorize a non-refundable deposit per seat. The deposit is credited to your final check. Booking through Tock is also subject to Tock's own terms and privacy notice.

We seat two parties per evening, by tasting menu only. Reservations are released sixty (60) days in advance. We do not accept walk-ins.

3. Cancellations & no-show policy

48-hour cancellation policy. You may cancel or modify your reservation up to 48 hours before your seating at no charge. Inside the 48-hour window, the per-seat deposit becomes non-refundable. No-shows are charged the full deposit per guest.

Party-size reductions inside 48 hours are charged the deposit for each removed seat. If we are forced to close due to weather, public-health order, or other circumstances outside our control, your deposit will be refunded or rebooked at your election.

4. Kitchen appreciation fee

A 3% kitchen appreciation fee is added to every check and is distributed in full to our back-of-house culinary team. This fee is disclosed on our menu and at the time of booking. It is in addition to gratuity, which remains at your discretion.

5. Dietary restrictions & allergens

Our menu features foraged and fermented ingredients (juniper, koji, miso, garums, wild mushrooms, stone fruit, game and fish). Please notify us of allergies or dietary needs at least 48 hours in advance so we can adapt the menu. While we take every reasonable precaution, our kitchen handles tree nuts, dairy, gluten, shellfish, fish, eggs and soy, and we cannot guarantee a fully allergen-free environment.

6. Alcohol policy

Alcohol is served only to guests aged 21 and older with valid US-government photo identification. We reserve the right to refuse service to any guest who appears intoxicated, in accordance with Colorado Revised Statutes Title 44 (Alcohol Beverage Code).

7. Conduct & right of refusal

Bosq is a 30-seat tasting menu room. We ask guests to silence phones and refrain from flash photography. We reserve the right to refuse service or remove any guest whose conduct disrupts the experience of other diners or the safety of our team, consistent with applicable law including the Americans with Disabilities Act and Colorado anti-discrimination law (CRS § 24-34-601).

8. Intellectual property

All text, photography, video, menu names, dish concepts, the Bosq word mark and logos appearing on the Site are owned by Bosq Aspen LLC or used with permission. You may not reproduce, distribute, or create derivative works without our prior written consent, except for personal, non-commercial sharing (for example, a social-media post of your own meal).

9. Limitation of liability

To the maximum extent permitted by law, Bosq Aspen LLC, its members, officers, employees and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or loss of goodwill — arising out of or relating to your use of the Site or your dining with us, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising from these Terms shall not exceed the amount you paid Bosq in the twelve (12) months preceding the event giving rise to the claim. Some jurisdictions do not allow these limitations; in such cases the foregoing applies to the fullest extent permitted by law.

10. Indemnification

You agree to defend, indemnify and hold harmless Bosq Aspen LLC from any claim, demand, loss or expense (including reasonable attorneys' fees) arising out of (a) your breach of these Terms, (b) your violation of any law or third-party right, or (c) your misuse of the Site.

11. Dispute resolution & binding arbitration

Please read this section carefully — it affects your legal rights.

You and Bosq agree to attempt in good faith to resolve any dispute informally by contacting info@bosqaspen.com for at least sixty (60) days before initiating any formal proceeding. If we cannot resolve the dispute informally, you and Bosq agree to resolve it through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before a single arbitrator in Pitkin County, Colorado, or, at your election, in your county of residence within the United States.

Class-action waiver. You and Bosq each waive the right to bring or participate in a class, collective, or representative action, except to the extent such waiver is prohibited by law.

Opt-out. You may opt out of this arbitration agreement by sending a written notice to info@bosqaspen.com with the subject line "Arbitration Opt-Out" within thirty (30) days of first accepting these Terms.

Notwithstanding the foregoing, either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual-property rights or address small-claims matters.

12. Governing law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles. Subject to Section 11, the state and federal courts located in Pitkin County, Colorado shall have exclusive jurisdiction over any matter not subject to arbitration.

13. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, post a notice on the Site or send an email to the address you provided at booking. Continued use of the Site or a future reservation constitutes acceptance of the updated Terms.
